Esta_Logo.jpg
ESTA is an automated system that determines the eligibility of visitors to travel to the United States under the Visa Waiver Program (VWP). Authorization via ESTA does not determine whether a traveler is admissible to the United States. U.S. Customs and Border Protection officers determine admissibility upon travelers’ arrival. The ESTA application collects biographic information and answers to VWP eligibility questions. ESTA applications may be submitted at any time prior to travel, though it is recommended that travelers apply as soon as they begin preparing travel plans or prior to purchasing airline tickets.

Please note that as of January 2016, the Visa Waiver Program has changed. Under the new changes, the following categories of travelers are no longer eligible to travel or be admitted to the United States under the Visa Waiver Program, and will need to apply for, and go through the standard Visa application process:

  • Nationals of VWP countries who have traveled or been present in Iran, Iraq, Sudan, or Syria on or after March 1, 2011 (with limited exceptions)
  • Nationals of VWP countries who are also nationals of Iran, Iraq, Sudan, or Syria. (Travelers who are known to fall into the dual national category noted above should have received notice via email on or about January 21, 2016 that their current ESTA is no longer valid).
These restrictions do not apply to VWP travelers whose presence in Iraq, Syria, Iran, or Sudan was to perform military service in the armed forces of a program country, or in order to carry out official duties as a full-time employee of the government of a program country. These military and official government services exceptions, however, do not apply to the dual national restriction.

The Act includes other changes to the VWP to promote enhanced information sharing of terrorism and criminal data, and use of INTERPOL databases and notices for border screening purpose. The vast majority of VWP eligible travelers will not be affected by the legislation.

GETTING YOUR VISA
INFORMATION

OSA provides the following information to help foreign travelers understand the process and requirements of obtaining visas and some of the rules for foreigners to stay in China. The information is accurate to the best of our knowledge. However, there is considerable complexity as there are several types; it can be applied for in your own country, within mainland, or in a third country; the rules vary according to your nationality, and the regulations can be changed at any time. The information is relevant to holders of ordinary passports. If you hold a diplomatic or service passport, there are different rules and you will need to get advice from your employer.

Mostly, a visa is a permit granted before travelling to enter a country, usually for a fee. However, it is only an indication to immigration officials that you have satisfied certain conditions. On arrival, the immigration official has the power to approve or disallow your entrance. So, when you arrive you can be told that you may not enter. This can be for many reasons including a belief that there is something wrong with the passport or the visa, you do not have enough money, and you plan to work when the type you hold does not allow this, or that you are in some other way 'undesirable'. There is normally nothing you can do about it and you will not be permitted to enter.

Note: With the implementation of the Regulation of the PRC on the Administration of the Entry and Exit of Foreign Nationals on September 1, 2013, new version of Visa Application Form of the PRC (Form V.2013) came into use simultaneously. All visa applicants are required to use the new Form from September 1, 2013. Please fill out the form truthfully and clearly on the computer and then print the completed form. Handwritten forms will no longer be accepted for application.
